This HIPAA Clarification Notice is provided to explain how Peña Family Care Services LLC handles personal information and to clarify our status under federal health privacy laws.

Not a HIPAA Covered Entity

Peña Family Care Services LLC is a private-pay, non-medical home care provider. We do not provide medical treatment, skilled nursing services, diagnosis, or healthcare services as defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

As such, Peña Family Care Services LLC is not a “covered entity” or “business associate” as defined by HIPAA.

Commitment to Privacy

Although we are not subject to HIPAA requirements, we take the privacy and confidentiality of personal information seriously. We handle personal information with care and discretion and limit access to information to individuals who require it for legitimate business purposes.

Types of Information Collected

Information we may collect includes names, contact details, addresses, and general information related to non-medical care needs. Any information collected is used solely for the purpose of evaluating service requests, coordinating care, communicating with clients or authorized representatives, and maintaining internal records.

Use and Disclosure of Information

Personal information is not sold or shared with unrelated third parties. Information may be disclosed only as necessary to provide requested services, comply with legal obligations, or protect the rights, safety, or property of clients, caregivers, or the business.

Medical Information Responsibility

Clients and families are responsible for maintaining relationships with licensed healthcare providers for all medical care. Peña Family Care Services LLC does not manage medical records, provide medical advice, or make clinical decisions.

This HIPAA Clarification Notice should be read together with our Privacy Policy, Terms of Use, and Non-Medical Care Disclaimer. In the event of any inconsistency, the Service Agreement governs services provided.
